• Anything less than the above minimum pax, an additional boat charter of USD135.00
  is to be imposed and this is non commissionable.
  
• The package includes all meals, relevant sea / land transfer from Tawau Airport to the resort, accommodation with air conditioning, hot shower/fresh water and attached bathroom & sundeck. Complimentary use of jacuzzi.
  
• Diver package A is includes 3 daily boat dives at Mataking / Pandanan / Bohayan &
  Unlimited Beach. Dive, tanks, weights / weight belt and experienced guide provided.
  However, for group size booking of 6 pax or more ( Diver package A ) and staying for
  minimum 5D/4N is entitled to a day trip to Sipadan Island (FOC) and not including Government Levy ( USD11 / pax ).
  
• Diver Package A + Night Dive is inclusive of the Diver package A plus 2 Guided Night Dives
  
• Diver Package B shall include an additional Boat day trip to Sipadan which shall be
  scheduled on every Wednesday Saturday only.
  
• Honeymooner package is inclusive of 1 cake, 1 bottle of champagne, 1 X 90 minutes session for the couple and Honeymoon Room decoration.
  
• Spa Package is inclusive of 2 X 90 minute sessions of Rejuvenation & Relaxing massage and 1 session of 150 minutes Traditional Body scrub, bath and massage per person
  
• Additional dive trip to Sipadan is charged USD160 per return boat trip plus government levy (USD11 / pax ). Sipadan trips are also subject to weather condition.
  
• For reservation, it can be made by phone or in writing either by facsimile or preferably email to our Tawau office. Once a booking for a space is made, a 10% reservation fee from the total package price must be paid within 7 days after the initial booking otherwise it will automatically be made available for resale. The fees are not refundable and full payments have to be settled 30 days before the date of arrival.
  
• Payment can also be made either by telegraphic transfer or by Credit Card with an
  authorized letter. Kindly be informed that our company shall not absorb any outstation bank charges and agents are required to pay to us the nett amount as agreed in the rates above.

(For any last minute cancellation, delay and change of arrangement made by the customer (Less than 48 hours Before Arrival Time as per schedule), the company shall not be held responsible and reserve the rights to change to the customer for additional costs rendered.)

• Surcharge during peak period of 10% is applicable for the period of August.

• Deposit is required upon confirmation and all payments made are non refundable in part or in full.
  
• If travel less than 4D/3N package a transfer surcharge will be impose at RM600 (return)
  
• Package price above is subject to room availability and rates are Nett inclusive of all taxes.
  
• Bookings subject to confirmation and booking terms. Ballzaction Sportsmart S/B & operators reserves the rights to change without prior notice. Minimum of 6 pax for package otherwise private transfer charges apply.
  
• No alcohol/drugs when diving
  
• No solo diving
  
• No decompression dive or exit the recreational diving limit (in terms of time & depth)
  
• Minimum one hour surface interval between dives
  
• No riding on turtles
  
• No crashing and holding onto corals
  
• No collecting dead/live sea shells, corals or marine lives
  
• No night dive and deep dive for Open water diver (unless previous experiences or records can be shown)
  
• No gloves
  
• In the event of no show, rooms will be automatically released and deposit will be forfeited.
  
• The company accepts no liabilities for losses incurred due to failure to connect with other services management and cannot be held liable for loss of baggage or personal belongings, illness, injury or death resulting from activities in which are beyond our control.
  
• The customer are advised to insure their own insurance coverage.
  
• Customers are also fully responsible to any damage to the resort property.
  
• Management reserves the right to alter, amend, delete or add to the conditions or withdraw the package at any time without prior notice.
  
• Divers are require to sign a liability release & express assumption of risk form. Dive Master reserve the right to exclude uncertified or unfit divers from diving.
  
• Dive master may at his discretion cancel diving activities due to unsafe condition and poor weather.
  
• Diver are not allowed to dive within a minimum of 12 hours prior to flying (recommended by PADI).
